MSW EVENTS Ltd (hereinafter referred to as ‘MSW’) provides event services including, but not limited to, first aid and event medical cover, ambulance services, security, water rescue support, and accredited medical training. By engaging the services of MSW, the Client agrees to be bound by these Terms and Conditions in full. MSW reserves the right to amend these Terms and Conditions at its sole discretion and without prior notice.
2 Booking and Payment Terms
All bookings must be made via direct contact through email correspondence with MSW. A non-refundable deposit equivalent to 25% of the total service fee is required to confirm any booking unless the total fee is under £250.00, in which case the full amount shall be payable at the time of booking. Full payment of any remaining balance must be remitted within seven (7) calendar days following the conclusion of the event, inclusive of weekends and bank holidays. Additional charges, which may not be included in the initial quotation, may apply for services such as but not limited to: overtime, damages, excessive use of medical equipment or consumables, and mileage (£1.50 per mile). The Client is advised to confirm whether such charges are applicable. In the event of delayed payment, MSW shall impose the following penalties: (a) a surcharge of 10% of the total invoice amount per working week (Monday to Friday) the payment remains overdue; and (b) a one-time administrative fee of £50. Failure to remit payment within the stipulated period may result in the cancellation of any future or ongoing bookings without further notice.
3 Cancellation and Refunds
All event cancellations must be submitted in writing to MSW operations@mswevents.co.uk. Cancellations received within 24 hours of the scheduled event shall incur a 100% cancellation fee. Cancellations received between 24 and 72 hours prior to the event shall incur a 50% cancellation fee. Cancellations received between 72 hours and seven (7) days prior to the event shall result in forfeiture of the deposit. Cancellations received more than seven (7) days prior to the event shall be eligible for a refund of the deposit, less a £50 administration fee. MSW reserves the right to cancel services at any time due to unforeseen circumstances including, but not limited to, extreme weather conditions, medical emergencies, operational limitations, or vehicle breakdown. In such cases, a full refund of any deposit or payment shall be issued. MSW reserves the right to cancel any future bookings without notice where outstanding payments remain unresolved.
All Courses provided by MSW are non-refundable, if you are unable to attend a course a voucher will be given for an alternative date. If MSW cancels a course and a new suitable date is not available a full refund will be returned to you.
4 Limitation of Liability
MSW shall not be liable for any loss, damage, or injury unless such arises due to proven negligence on the part of MSW. MSW accepts no liability for the actions or omissions of third parties, including subcontracted medical professionals or other personnel. MSW liability shall be limited strictly to the value of the services contracted.
MSW maintains valid professional indemnity and public liability insurance. The Client is solely responsible for ensuring appropriate insurance coverage for their event, including cancellation and personal accident insurance. 5 Insurance
6 Data Protection
MSW will process personal data in accordance with applicable data protection legislation. MSW shall use personal data solely for the provision of contracted services and shall not disclose such data to third parties except where necessary.
7 Governing Law and Jurisdiction
These Terms and Conditions shall be governed by, and construed in accordance with, the laws of England and Wales. Any disputes arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
8 Operational Flexibility
MSW reserves the right to alter staffing levels on the day of the event due to operational necessity, availability, or safety requirements. The Client shall be informed of any such changes at the earliest practicable opportunity. MSW reserves the right to charge the Client for any additional staffing costs incurred as a result of such changes where necessary to ensure the safe delivery of services. By proceeding with a booking, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
9 Documentation and Planning
It is the responsibility of the Client to provide all necessary event information, including but not limited to site maps, key contact numbers, and event-specific risk assessments, no later than fourteen (14) calendar days prior to the commencement of the event. Failure to provide such documentation within the stated timeframe shall incur an administrative surcharge of £50.00. Once an event plan has been prepared and issued by MSW, any amendments requested by the Client shall be subject to a fee of £50.00 per amendment. 9.4 If a complete rewrite of the event plan is required due to substantial changes, a charge of £100.00 shall apply. All quotations issued by MSW are final. No itemised or detailed breakdown of quoted fees shall be provided under any circumstances.
10 Site Meetings and Recce Visits
10.1 The service fee includes one (1) site meeting or recce visit prior to the event. Only mileage will be charged for this initial meeting, calculated at the standard rate of £1.50 per mile.10.2 Should additional site meetings or recce visits be requested by the Client, these shall be charged at a rate of £250.00 per meeting, in addition to applicable mileage charges.
11 Subcontracting and Safeguarding
MSW reserves the right to engage qualified third-party contractors and subcontractors for the provision of any part of its services, including but not limited to medical staff, rescue personnel, or training providers. MSW shall ensure that all subcontracted personnel meet the requisite standards of training, certification, and professionalism. MSW reserves the right to report any concerns regarding the safety, legality, or operational management of an event directly to the relevant local authority or regulatory body, without prior consultation or notification to the Client.
